DMCA Copyright Policy

Nyasekai respects the intellectual property rights of others and expects our users to do the same. We respond to notices of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") and applicable laws.

Filing a DMCA Takedown Notice

To file a copyright infringement notification, you must provide a written communication that includes all of the following elements as required by the DMCA (17 U.S.C. § 512(c)(3)):

1. Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, including the URL or other specific location of the material.
3. Your contact information, including your name, address, telephone number, and email address.
4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
6. Your physical or electronic signature.

Counter-Notice Procedure

If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with our DMCA Agent. Your counter-notification must include:

1. Your physical or electronic signature.
2. Identification of the material that was removed or disabled and the location where it appeared before removal.
3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
4. Your name, address, telephone number, and email address.
5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside Switzerland, any judicial district in which Nyasekai may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original claim. If the original claimant does not file a court action within 10-14 business days, we may restore the removed content.

Repeat Infringer Policy

Nyasekai has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the platform and/or terminate the accounts of any users who infringe the intellectual property rights of others, whether or not there is any repeat infringement.

User Responsibilities

By uploading content to Nyasekai, you represent and warrant that:

• You own or have the necessary rights, licenses, consents, and permissions to use and authorize Nyasekai to use all intellectual property rights in your content.
• Your content does not infringe, violate, or misappropriate any third-party rights, including copyright, trademark, patent, trade secret, moral rights, privacy rights, rights of publicity, or any other intellectual property or proprietary rights.
• You have obtained all necessary permissions from any individuals who appear in your content.

Additional Information

While the DMCA is a United States law, Nyasekai operates internationally and respects intellectual property rights globally. We will process takedown requests in accordance with applicable international copyright laws and treaties, including:

• EU Copyright Directive (DSM Directive)
• Berne Convention for the Protection of Literary and Artistic Works
• WIPO Copyright Treaty
